Earning settlement status and British citizenship

Once resident in the UK for a certain time period, you can gain settlement status and full British citizenship.

Settlement

Settlement means permanent residence in the UK, and it gives you the right of staying in the UK indefinitely and of being able to work and move without restriction (i.e. without the need for visas or work permits). However, you cannot leave the UK for more than two years at a time or you run the risk of losing your settlement status.

Settlement status can be obtained:

  • After one year of being married to a British citizen
  • If you have had a residence permit for four years, during which you have been in continuous employment
  • If you have been in the UK legally for ten years.

Citizenship

To become a British citizen you need to fulfil certain conditions:

  • To have been a permanent resident in the UK for at least one year
  • To have legally lived in the UK for a minimum of 5 complete years (with no more than 450 days spent abroad, and no more than 90 days on the year leading up to the application)
  • Intend to continue living in the UK
  • Have adequate knowledge of English, Gaelic or Welsh
  • Be of “good character” (i.e. have no criminal record).

You can also apply for naturalisation if you are over 18 and married to a British citizen, as long as you are allowed to live in the UK as a permanent resident, and you have lived in the UK legally for at least three years (with no more than a total of 270 days spent abroad, and no more than 90 days on the year leading up to the application).

    if somebody is working in a British embassy in a foreign country and he/she is not British nor has any British relatives. Does this allow him/her to get the British Citizenship after some period of time?

      Foreign nationals working in British Embassies elsewhere abroad or inside UK or even working for Immigration and Naturalisation directorate, has got nothing to do with becoming citizens in UK. Like other immigrants you need to have been resident in the United Kingdom for at least five years.

    This is untrue, you must have Limited leave to remain and be in the UK with your spouse for at least two years before you can successfully apply for ILR. Alternatively I think you can be married outside of the UK, to a UK citize for 4 years, and then apply straight away for ILR.

      It it permissable for a non eu national, who is married to a British Citizen, to visit home with less than six months left on his 2year limited leave to remain PERMIT???
